These Terms of Use ("Terms") govern access to and use of the website "borume.co.za" (together with all content and functionality made available through it, the "Website"), operated by Tubidy Limited ("Tubidy"). By visiting or otherwise using the Website — whether as a registered or unregistered user, and whether an individual or a single entity ("You" or "Your") — you unconditionally accept these Terms along with every other Tubidy policy, including the Tubidy Privacy Policy. If you are acting on behalf of an entity rather than as an individual, you confirm to Tubidy that you hold the corporate or equivalent authority needed to bind that corporation, partnership, association, or other entity to these Terms through your registration and account setup. Should you disagree with any part of these Terms, you must not use the Website.

Description Of The Website

borume.co.za is a free, original video hosting site built to let people access, view, upload, store, and share their own videos. Storage space is unlimited, though to keep bandwidth costs under control, each video is capped at 16 minutes in length and 100 MB in size. The Website is not intended to function as a backup service for your videos, so safeguarding your own copies remains your responsibility. As is common practice across the internet, advertisements may appear throughout the Website.

Your Intellectual Property Rights

Uploading video content that you have created requires a registered borume.co.za account. Once uploaded, your content becomes visible to other users, and by uploading you consent to letting any Website user view and transmit that content — free of charge, for personal use only — on or through the Website and through any other current or future electronic communication medium or technology (smartphones, tablets, connected TVs, game consoles, and so on), for as long as your content remains hosted on the Website. Given the nature of the internet and digital media, transmitted data — including your content — can never be fully shielded from misappropriation or piracy risks, and borume.co.za bears no liability for such outcomes. Protecting your own data, where relevant, is your responsibility. For however long your content stays hosted, you also grant borume.co.za a non-exclusive, royalty-free license to reproduce, display, perform, distribute, and transmit your content, in whole or in part, across every feature that makes the Website accessible online and through any other current or future electronic medium or technology, and to reformat your content as needed for reproduction, display, or transmission purposes.

Other Users Intellectual Property Rights

Downloading, copying, reproducing, distributing, transmitting, broadcasting, displaying, selling, licensing, or otherwise exploiting borume.co.za Content for any purpose requires Tubidy's prior written consent. You agree not to use or exploit borume.co.za Content in any way that runs counter to the rights granted or restrictions imposed here, including but not limited to downloading, redistributing, altering, deleting, or deactivating any content protection mechanism. Limitation Of Liability

Nothing here excludes or limits borume.co.za's liability where such exclusion or limitation would be unlawful under applicable law. Beyond that, borume.co.za carries no liability to you for indirect or consequential losses, which includes: (i) lost profit, direct or indirect; (ii) lost goodwill or business reputation; (iii) lost opportunity; or (iv) lost data. This also covers any loss or damage stemming from: reliance you place on the completeness, accuracy, or existence of any advertising, or from any dealings or transactions between you and an advertiser or sponsor whose ads appear on the Service; changes borume.co.za makes to the Service, or any temporary or permanent halt to the Service or particular features within it; deletion, corruption, or failure to store any content or communications data tied to your use of the Service; inaccurate account information you've supplied to borume.co.za; or your failure to keep your password or account details secure. These liability limits apply regardless of whether borume.co.za was informed of, or should reasonably have anticipated, the possibility of such losses.

Copyright Notifications

Registration And Access

Once registered, log in from the homepage using your username and password in the fields provided. Keeping your username and password secure is entirely on you. Registration grants you the right to use the Website, and we may terminate your account at any time. Breaching these Terms or any other borume.co.za policy can lead to your personal page being suspended — temporarily or permanently, immediately and without notice — or your account being deactivated, without affecting any other rights we may hold.

Ability to Accept Terms & Conditions

Where our computer records conflict with any paper or electronic documents you hold, our records take precedence and are treated as authoritative.

Content Restrictions

Submitting (uploading, posting, or transmitting) any video, image, text, audio recording, or other work is not permitted where that content:

Infringes a third party's copyright or other rights (trademark, privacy, etc.); Is sexually explicit or pornographic; Is hateful, defamatory, or discriminatory, or incites hatred toward a person or group; Exploits minors; Depicts unlawful acts or extreme violence; Depicts cruelty or extreme violence toward animals; Promotes fraudulent or dubious business schemes; or Breaks any law.

Electronic Signatures

These Terms form the complete agreement between Tubidy and you regarding the Website, replacing any prior or contemporaneous communications and proposals — electronic, oral, or written — between the two of you on this subject. A printed version of these Terms, and of any notice originally given electronically, will be admissible in judicial or administrative proceedings relating to these Terms, on the same footing as other business records originally created and kept in printed form. Should a court of competent jurisdiction find any part of these Terms unenforceable, that part will be enforced to the fullest extent possible to preserve the intent of the Terms, with the rest remaining in full force. Neither party's failure to enforce a breach or default constitutes a waiver of any earlier or later breach or default.
